Yep. The next Supreme Court Justice, Judge Sotomayor had her decision reversed by the Supreme Court of the United States. And at first glance, it would seem that she was rebuked, but as Chuck Todd pointed out on “Morning Joe” on MSNBC, there is a hitch there.
And that hitch is that the 5 Justices that decided to rule in favor of the white firefighter decided to use judicial activism to come to their ruling. Now, according to the Supreme Court it isn’t enough for a city to be sued for racial discrimination to overrule the hiring practices, but the municipality must have a belief that it will lose any lawsuit that is filed against it in order for it to throw out any or all parts of tests for hiring or promoting people.
How rich is this. Conservative judges deciding to break the constitution and start making laws from the highest court in the land. And I can already hear the crickets chirping from the conservatives about this. All the ballyhoo about activist judges from the left seems to be so much hot air. And the fact the Judge Sotomayor said that she made law from the bench just like other judges seems to be the truth. At least that is the way it looks here with the ruling from the Supremes. And with this ruling comes the realization that all her statements will not deny President Obama his choice of a judge from being on the Supreme Court.
